Intentional Injury Of The Employee
Where
an employer intentionally injures an employee, it may fall outside the
provisions of worker’s compensation statutes. Such statutes generally
protect employees from accidental injury. However, as with any
intentional injury, the conduct may give rise to a common law claim
for damages in tort, where the employee may sue outside of worker’s
compensation system and collect huge sums, which may include awards
for pain and suffering and punitive damages.
