Physical Pain And Suffering
Where an employee
suffers from pain and suffering alone, without physical injuries,
Workers’ Compensation statutes do not provide for benefits unless the
pain and suffering will affect the employee’s ability to earn a
living. Therefore, if exclusivity applies and the pain/suffering do
not affect the ability to earn money, there is no remedy. Exclusivity
produces its harshest results in these instances.
