Where an injured employee has the option of suing not only the employer under the Workers’ compensation statute but also the third party in common law, the majority of states do not require the employee to choose between the two. Moreover, in the minority of states that do require an election, the employee is usually allowed to sue in the second forum if unsuccessful in the first.
