Injury While On A Break
The
rule governing injury during a break is essentially the same for
injury while commuting to and from work. If injury occurs on the
employer's premises, then it arises out of employment. If however, it
occurs off the premises, then it is not compensable. Thus, where an
employee leaves the premises for a lunch break, he is subject to the
same rules distinguishing public property and the employer's property
as described above.
