Injury While Eating On The Job
The rule governing
injury while eating on the job is straightforward and in sync with the
rule governing injury while commuting to and from work. The rule is
that injury suffered while eating on the job arises within the scope
of employment when it occurs on the employer’s premises. If the
employee leaves the premises, then compensability depends on whether
the injury occurs during some other activity within the scope of
employment as discussed above, such as an errand for the employer.
