According to the majority of states, where exclusivity does not apply and the employee tries to sue in one forum, such as under the Workers’ Compensation statute, and loses, he/she can try again in the other forum, such as in tort. However, an exception applies where the employee failed to diligently pursue his/her claim in the first forum. |
